Terms of Service

1. Acceptance of Terms

By accessing or using Unakumbuka Digital Memorial Platform, operated by Laitigo Labs (LL), you agree to be bound by these Terms of Service. If you do not agree, please do not use our platform.

2. Account Responsibilities

  • You must provide accurate and truthful information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 18 years old, or have parental consent, to use this platform
  • One person may not maintain multiple accounts

3. Memorial Content Guidelines

  • Memorials must be created in good faith for actual deceased persons
  • No hate speech, harassment, or content that disrespects the deceased or their family
  • No creation of false or fraudulent memorials
  • Uploaded photos and content must not violate third-party rights
  • We reserve the right to remove content that violates these guidelines

3b. AI-Assisted Features

  • Unakumbuka may offer AI-powered tools to help you write tributes, translate content, or generate suggestions
  • AI-generated content suggestions are provided as-is and may not always be accurate or culturally appropriate
  • You are responsible for reviewing and approving any AI-assisted content before publishing
  • AI-generated demo images are clearly labelled and are not representations of real persons
  • We do not use your personal content to train AI models
  • AI features may be subject to usage limits based on your subscription tier

4. Fundraising Rules

  • Fundraising campaigns must be for legitimate funeral, memorial, or bereavement purposes
  • The campaign organizer is solely responsible for the proper use of raised funds
  • Unakumbuka acts as a platform facilitator, not a financial guarantor
  • Misuse of fundraising features may result in account suspension
  • Unakumbuka may charge a platform fee on fundraising transactions

5. Service Provider Terms

  • Service providers listed on our marketplace are independent businesses
  • Unakumbuka may charge a commission on bookings made through the platform
  • Disputes between users and service providers should first be resolved directly
  • Unakumbuka may mediate but is not liable for service provider performance

6. Intellectual Property

Users retain ownership of content they upload. By posting content on Unakumbuka, you grant us a non-exclusive, worldwide license to display, distribute, and promote that content within our platform. The Unakumbuka name, logo, and platform design are our proprietary property.

7. Payment Terms

  • Payments are processed via M-Pesa through the Safaricom Daraja API
  • Donations to fundraising campaigns are generally non-refundable
  • Subscription cancellations take effect at the end of the current billing period
  • All amounts are in Kenya Shillings (KES) unless otherwise stated

8. Limitation of Liability

Unakumbuka is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability shall not exceed the amount you have paid to us in the preceding 12 months.

9. Governing Law

These Terms shall be governed by and construed in accordance with the Laws of Kenya.

10. Dispute Resolution

Any disputes arising from these Terms shall first be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be referred to arbitration in Nairobi, Kenya, under the Arbitration Act (Cap 49, Laws of Kenya).
